Purpose and Reason:

The proposed amendment to the Medicaid Program Rule reflects statutory increases in the basic allowances for a community spouse and other dependents of an institutionalized individual. These basis allowances are used in the post-eligibility treatment of income process to calculate the allocation of income from an institutionalized individual to community dependents. The following standards were implemented effective July 1, 2012 under Emergency Rule Making to ensure the allowances were in compliance with state and federal guidance: minimum monthly maintenance needs allowance (MMMNA) for a community spouse with no income was increased to $1,891.25; the basic allowance for a dependent living with a community spouse when the dependent has no income was increased to $630.42; the excess shelter allowance was increased to $567.38.
